Our Privacy Commitment

ProductionBeast's parent company, StudioBinder Inc ("PB," "we," "us" or "our") is committed to respecting the privacy rights and concerns of all users of the PB website and mobile applications where this Privacy Policy is posted (the "Site") (we refer to the Site, the services and, when applicable, the software made available through the Site and the mobile applications developed and/or published by PB, collectively, as the "PB Features"). By visiting the Site, downloading the PB Features when made available, or using any of the PB Features, you consent to PB's collection, use, storage, deletion and disclosure of information relating to you as set forth in this Privacy Policy. This Privacy Policy is effective as of the date set forth above and is only applicable to the Site and not to any other website that you may be able to access from the Site which may have its own data collection and use practices and policies.



1. What information do we collect and how do we use it?

a. Types of Information We Collect

Personal information means information that can be used to identify and contact you. You do not need to submit personal information to access certain areas of the Site, but if you do not want to disclose certain personal information to us, you will not be able to access certain aspects of the PB Features. The PB Features are a social network for the entertainment production industry, offering its members a way to easily connect with other professionals within the entertainment space. To become a member of the PB Features, we require you to provide your first and last name and email address. The only items which are required to be displayed on your PB Features profile page are your first and last name, although you may elect to display your job function, the city and state in which you reside and other information that you voluntarily select to be displayed on your profile page. The PB Features give you the option to display your telephone number, social network information (such as twitter handle, LinkedIn account and Facebook account), biographical information, photograph, address, email and other contact information, but these items are not required to be displayed to open a PB Features account. PB only collects and displays the contact information that you voluntarily provide to us.

We collect personal information when you create an account through the PB Features, log into an account or associate an account for the PB Features through your other social network accounts, such as your Facebook account, LinkedIn account or Twitter handle, participate in chat rooms, forums, bulletin postings, postings on your FB Features profile, polls, surveys and questionnaires, or when you receive customer or technical support. If you use the PB Features with your mobile device, we may also collect information about the make and model of the mobile device, its operating system, mobile network information and unique identifier. To learn more about how we use a mobile device's unique identifier, see the "Mobile Permissions" section below.

Additionally, we may also collect other types of information (known as demographic information) such as your age, marital status and hobbies. This demographic information may be associated with your personal information.


b. How We Use Your Personal Information

The personal information you provide to us will allow us to send you information about new products or services, features, or enhancements, fulfill your product or service order; provide regular news letters; and handle your customer service questions or issues. We also use your email address as part of the PB Features in sending you legal notifications about the PB Features, such as updates to policies and procedures. Additionally, we will use your personal information, such as your name, to connect your profile with productions you have worked on in the past. For example, we will list out your credits in the entertainment industry that we are able to access from publicly-available records and from our business partners. We may further use your profile picture in PB's promotional or marketing material.


c. Mobile Permissions

We are currently developing mobile applications that provide the PB Features.

Your mobile device manufacturer provides certain settings that allow us to provide information to make your experience with the PB Features more convenient. For example, when you return to the PB Features on your mobile device after logging in, these setting provide information that will recognize who you are on subsequent visits, speeding up your experience of the PB Features.

When we release the PB Features-enabled mobile applications, you will be able to access the PB Features through your mobile device. If you have "location services" enabled for the PB Features on your mobile device, we will collect the location from which you access the PB Features. If you do not want us to track your location, make sure to disable the "location services" in your mobile device's settings for the PB Features.


d. Cookies

"Cookies" are small bits of electronic information that a website sends to a visitor's browser and are stored on the visitor's hard drive. While we do not currently implement cookies, we may employ cookies in the future in certain areas of the Site to allow us to provide information which is targeted to your interests and to make your online experience more convenient. For example, when you return to one of our websites after logging in, cookies provide information to the website so that the website will remember who you are. These uses may include saving your login name and passwords, keeping track of your click streaming data, tailoring web content and advertisements to your interests, and personalizing the Site. Should we implement cookies on the PB Features and you disable cookies in your browser, you may not be able to access certain PB Features or areas of the Site.


E. Log Information

Our servers automatically record information that your browser sends whenever you visit the Site. This information includes your IP address, your browser type and version, the search engine you used to find the PB Features, if any, the operating system your computer uses, which PB Features you use and when and how long you use them. We use this information to monitor and analyze how users use the PB Features, to provide customer service, and to maintain and improve the PB Features. Please be aware that advertisers or websites with links to and from our Site(s) may collect personal information about you (e.g., Google analytics). This Privacy Policy does not apply to those advertisers or websites, and you should look at their privacy policies for details of their use of your information.


f. Children's Privacy

We do not knowingly collect personal information from children under 13, or allow them to create an account for the PB Features. We take children's privacy seriously, and encourage parents to play an active role in their children's online experience at all times.



2. Will we share your personal information with third parties?

a. Sharing of Information

We use your personal information to complete transactions, respond to your requests, and deliver products or services you request. We may share your personal information with carefully selected vendors and business partners, including companies that perform marketing services and other business operations for us. In addition, we will share the personal information we collect from you under the following circumstances:

  • Protection of rights. We will share personal information if we have a good faith belief that (i) access, use, preservation or disclosure of such information is reasonably necessary to satisfy any applicable law, regulation, legal process, such as a court order or subpoena, or a request by law enforcement or governmental authorities, (ii) such action is appropriate to enforce our terms of use and/or end user license agreements for the PB Features, including any investigation of potential violations thereof, (iii) such action is necessary to detect, prevent, or otherwise address fraud, security or technical issues associated with the PB Features, or (iv) such action is appropriate to protect the rights, property or safety of PB, its employees, users of the PB Features or others.
  • Asset transfers. If we become involved in a merger, acquisition or other transaction involving the sale of some or all of PB's assets, user information, including personal information collected from you through your use of the PB Features, could be included in the transferred assets. Should such an event occur, we will use reasonable means to notify you through email and/or a prominent notice on the Site.
  • Service Providers. We may share your personal information with service providers that we engage for the purpose of processing information on our and your behalf. For example, we may partner with other companies to process, analyze, and/or store data, including associating a list of your production credits with your PB Features profile. While providing services for us, these companies may access your personal information. To the extent applicable, we require these entities to comply with this Privacy Policy and appropriate confidentiality and security measures.


b. Additional Information You Should Know About Third Parties

This Privacy Policy does not cover the information practices of third party social networks which interact with the PB Features or websites linked to the Site. Although we encourage such third parties to adopt and follow their own privacy policies, we are not responsible for their collection and use of your personal information. You should refer to the privacy policies and statements of such social networks or websites or contact the respective webmasters or hosts of those social networks or websites to obtain information regarding their information collection, use and disclosure policies.

When you have clicked on a third party logo or URL displayed on our Site which links you to a different website, our Privacy Policy no longer applies and you must read the privacy policy of the third party to see how your personal information will be handled on their website.

The PB Features provide PB Features users the ability to easily share contact information. When you submit your contact information through the PB Features, the PB Features will share that contact information with other PB Features users according to the preferences that you set. Other PB Features will also be able to contact you by sending messages through your PB Features profile. Note that any PB Features users may contact you through your PB Features profile. If you do not want other PB Features users to have the ability to contact you, you should not use the PB Features. Note that if other PB Features users contact you, it is your responsibility to determine whether you should respond to such PB Features users and you do so at your own risk.



3. What choices do you have about the collection and use of your personal information?

a. Control of Your Information

You may access, update or delete the personal information you have provided to us by writing to us at support@productionbeast.com or accessing the privacy features through your account settings on the Site. Please note that when you ask us to delete your information, we may retain your account information for a reasonable period of time afterward for the purpose of internal account management and fraud prevention activities.


b. Mediation

If you are a resident of a country outside of the European Union, you also agree that, in the event any dispute or claim arises out of or relating to this Privacy Policy that you and PB will attempt in good faith to negotiate a written resolution of the matter directly between the parties. You agree that if the matter remains unresolved for forty-five (45) days after notification (via certified mail or personal delivery) that a dispute exists, all parties shall join in mediation services in Los Angeles, California with a mutually agreed mediator in an attempt to resolve the dispute. Should you file any arbitration claims, or any administrative or legal actions without first having attempted to resolve the matter by mediation, then you agree that you will not be entitled to recover attorney's fees, even if you would otherwise be entitled to them.


c. Dispute Resolution for Residents of the European Union

If you are a resident of the European Union, in the event that you have any dispute or claim arising out of or relating to this Privacy Policy, you may report your claim to the European Union Data Protection Authorities located in your jurisdiction.



4. What security measures do we take to safeguard your personal information?

The personal information that you provide to us is stored on servers, which are located in secured facilities and protected by protocols and procedures designed to ensure the security of such information. In addition, we restrict access to personal information to PB employees and agents who need to know this information in order to develop, operate and maintain the PB Features. However, no server, computer or communications network or system, or data transmission over the Internet can be guaranteed to be 100% secure. As a result, while we strive to protect user information, we cannot ensure or warrant the security of any information you transmit to us or through the use of any of the PB Features and you acknowledge and agree that you provide such information and engage in such transmissions at your own risk. Once we receive a transmission from you, we will endeavor to maintain its security on our systems.



5. European Commission's Directive on Data Protection - Safe Harbor

PB complies with the U.S.-EU Safe Harbor Framework and the U.S.-Swiss Safe Harbor Framework as set forth by the U.S. Department of Commerce regarding the collection, use, and retention of personal information from European Union member countries and Switzerland. PB has certified that it adheres to the Safe Harbor Privacy Principles of notice, choice, onward transfer, security, data integrity, access, and enforcement. This Privacy Policy may change from time to time and we will post all changes on this page.
